Expressions such as \u201cby\u201d, \u201cattributed to\u201d, \u201cstudio of\u201d, \u201cschool of\u201d or \u201cstyle of\u201d are not interchangeable marketing language. The Marcus Decree gives them specific consequences.<\/p>\n<h2>A vocabulary designed to reduce uncertainty<\/h2>\n<p>The <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/LEGITEXT000006063458\/\">Decree of 3 March 1981<\/a> was adopted to impose greater precision in descriptions used for sales of works of art and collectibles. It requires the seller or intermediary to stand behind the specifications given as to the nature, composition, origin and age of the object.<\/p>\n<p>Alexis Fournol previously analysed the structure and purpose of the text in <a href=\"https:\/\/magazine.interencheres.com\/art-mobilier\/lauthenticite-des-oeuvres-dart-le-decret-marcus-un-texte-fondamental-du-marche-de-lart\/\">an article for Interencheres<\/a>, noting that the Decree creates a hierarchy of attributional certainty and helps objectivise the expectations of the parties.<\/p>\n<h2>\u201cBy\u201d or the unqualified name of the artist<\/h2>\n<p>Under the Decree, the use of \u201cby\u201d or \u201cof\u201d followed by the artist\u2019s name, or the artist\u2019s name immediately followed by the title of the work, guarantees authorship. An indication that a work bears the signature or stamp of an artist also carries a guarantee of authorship unless an express reservation is made.<\/p>\n<p>For auction houses and dealers, an unqualified attribution therefore carries significant legal weight. It should not be used merely because an attribution appears commercially plausible.<\/p>\n<h2>\u201cAttributed to\u201d<\/h2>\n<p>The expression \u201cattributed to\u201d does not guarantee authorship. It guarantees that the work was produced during the artist\u2019s period of activity and that serious presumptions identify the named artist as the probable author.<\/p>\n<p>The distinction is fundamental. The term introduces uncertainty into the contract, but it is not an empty disclaimer. There must still be serious grounds for the probable attribution.<\/p>\n<h2>\u201cStudio of\u201d, \u201cschool of\u201d and \u201cstyle of\u201d<\/h2>\n<p>\u201cStudio of\u201d signifies a close link with the artist\u2019s working environment and, under the Decree, with execution in the artist\u2019s studio or under the artist\u2019s direction. \u201cSchool of\u201d refers more broadly to the work of a pupil or follower influenced by the named master and includes a defined temporal connection.<\/p>\n<p>Expressions such as \u201cstyle of\u201d, \u201cmanner of\u201d, \u201cafter\u201d or equivalent formulations do not provide the same guarantee of artist, date or school. Their function is descriptive rather than an authorship warranty.<\/p>\n<h2>Why the exact wording matters in litigation<\/h2>\n<p>If an authenticity dispute later arises, the court examines what was promised at the time of sale.
