French procedure provides interim and protective mechanisms, but the correct application depends on the type of risk and the evidence available.

Urgent proceedings before the French civil courts

Under Article 834 of the Code of Civil Procedure, the president of the tribunal judiciaire may order urgent measures that do not encounter a serious dispute or that are justified by the existence of a dispute.

Separately, Article 835 allows protective or restorative measures, even where there is a serious dispute, where necessary to prevent imminent harm or put an end to a manifestly unlawful disturbance. It also provides for certain orders where the obligation is not seriously contestable.

The relevant route depends on what the applicant is trying to protect and on the legal and factual basis of the request.

The measure should match the actual risk

In an art dispute, urgency can arise from an imminent auction, proposed delivery, export, transfer to a third party, threatened alteration of the object or other event capable of making the final judgment ineffective or substantially harder to enforce.

The application should identify that concrete risk rather than rely on the general value or uniqueness of the artwork alone. Courts will examine the legal conditions for the specific interim relief sought.

Evidence preservation may require Article 145 instead

If the immediate objective is to preserve or establish evidence rather than restrain conduct, Article 145 may be the more appropriate tool. A threatened restoration, movement or deterioration of an artwork can create both protective and evidentiary concerns, and the procedural strategy may need to address both.

This is one reason early French advice can be important: different urgent mechanisms have different conditions and objectives.

EU disputes can require cross-border coordination

Article 35 of the Brussels I Recast Regulation permits applications to the courts of a Member State for provisional or protective measures available under that State’s law even where the courts of another Member State have jurisdiction over the substance, subject to the Regulation’s rules and case law.

In a France/Belgium matter, for example, merits proceedings and urgent protective steps may need to be coordinated across the two jurisdictions depending on where the artwork, party or relevant risk is located.

Ownership disputes require particular care

An applicant seeking to block a sale or obtain protective relief may need to demonstrate a credible title or contractual position. Physical possession of the artwork does not by itself resolve ownership.

Our publications on ownership claims, stolen art and possession vaut titre explain the French-law background that may become relevant to interim relief.

Urgency changes how international teams should work

Foreign counsel should send French counsel the transaction documents, chronology, threatened event, evidence of location and relevant contractual clauses immediately. The legal team can then identify whether the urgent objective is preservation, restraint, recovery, evidence or enforcement.

In art matters, delays of days rather than months can determine whether the object remains practically accessible.

About the author

Alexis Fournol, Attorney at the Paris Bar and Partner at Fournol & Associés, advises and represents French and international art-market professionals, collectors, experts and institutions in disputes involving art, cultural property, authenticity, ownership, customs and related criminal or regulatory issues.

How Fournol & Associés can assist

Fournol & Associés acts in urgent French art-market matters involving imminent auctions, disputed delivery or transfer, ownership claims, evidence preservation and other situations requiring rapid court action.
