In art litigation, a court-appointed expert can become the factual centre of the case. <\/strong>Authenticity, attribution, materials, condition, restoration, valuation or professional practice may require technical knowledge that the judge does not possess. French procedure provides a structured expert process, and international parties should prepare for it as carefully as they prepare their legal submissions.<\/p>\n

The French judge can appoint a technical expert<\/h2>\n

Under Article 232 of the Code of Civil Procedure<\/strong><\/a>, a judge may appoint a person to assist through findings, consultation or expertise on a factual question requiring technical knowledge. A thorough understanding of the experts who may be recommended to the judge for appointment is essential in this context.<\/p>\n

The expert\u2019s mission is defined by the court. In an art dispute, wording matters. A mission framed too broadly may draw the expert into legal questions; one framed too narrowly may fail to address the technical issue that will determine the case.<\/p>\n

The judicial expert process is adversarial<\/h2>\n

The parties participate in the expert operations, provide documents, make technical submissions and respond to the opposing side. Article 276 of the Code of Civil Procedure<\/strong><\/a> requires the judicial expert to take parties\u2019 observations and claims into consideration and, in the final opinion, indicate how they were addressed.<\/p>\n

For foreign clients, this is important because technical positions should not be reserved for the final merits submissions. The court-appointed expert stage has its own deadlines and evidentiary dynamics. A party that fails to present its technical case effectively during the expertise may find it difficult to repair the record later.<\/p>\n

Private experts still matter<\/h2>\n

A court-appointed expert is not the only specialist who may be involved. Parties may retain art historians, conservators, scientists, valuers, provenance researchers or other technical advisers to help analyse the object and respond to the court expert.<\/p>\n

The role of the private expert is often to assist counsel and the client in understanding the technical record, identifying necessary tests and formulating observations within the court-appointed process. In fact, it is often essential to retain a private expert before any legal proceedings begin in order to build the case and demonstrate the need to engage a court-appointed expert.<\/p>\n

The court is not bound by the expert<\/h2>\n

Under Article 246 of the Code of Civil Procedure<\/strong><\/a>, the judge is not bound by the technician\u2019s findings or conclusions. The report is therefore highly influential evidence, but not a judgment.<\/p>\n

This distinction matters in authenticity disputes. Legal concepts such as contractual description, mistake, liability or burden of proof remain for the court, even where they depend heavily on the factual conclusions of an expert.<\/p>\n

International coordination can be essential<\/h2>\n

The relevant scholar, archive, laboratory or previous owner may be abroad. The artwork may have a provenance extending through several jurisdictions. A French court expertise can therefore require evidence and specialist input from outside France.<\/p>\n
