The applicable regime can depend on the date and circumstances of discovery and on the status of the land.

This means that ordinary assumptions based on possession or a private sale should not automatically be applied to an archaeological object without checking whether heritage legislation governs its ownership.

The place and date of discovery can be decisive

For many antiquities, the crucial provenance question is not simply who owned the object twenty years ago, but where and when it first entered the market. An object with no documented history before a recent date may require closer examination, particularly if it is of a type commonly associated with archaeological excavation.

Collection labels, old photographs, publications, estate records and historic auction catalogues can sometimes establish an earlier presence on the market and become highly significant evidence.

Foreign antiquities create additional legal questions

Where an object originated outside France, its lawful export from the country of origin may need to be considered alongside French ownership law. National patrimony laws differ, and some States assert public ownership over archaeological material from the date of discovery.

For objects unlawfully removed from another EU Member State after 31 December 1992, the French Heritage Code’s EU return mechanism may also become relevant. Objects originating outside the EU can raise different international, customs and criminal-law questions.

Ownership, customs and criminal law may overlap

A collector may face several issues at once: a foreign State may assert ownership, French Customs may request origin or import documentation, and investigators may examine whether the object has an archaeological character. These are related questions but they are not legally identical.

The existence of an incomplete provenance should therefore not be treated as automatic proof of an offence or absence of title. The object, documents, applicable laws and chronology must be analysed together.

What should a buyer retain?

For significant antiquities, a robust transaction file can include the invoice, seller identity, previous collection history, auction catalogues, export or import documentation, publications, photographs, expert opinions and relevant correspondence.

Where a dispute or customs control has already begun, documents should be preserved in their original form and reviewed before explanations are provided to a claimant or authority.

About the author

An article written by Alexis Fournol, Attorney at Law and Partner at Fournol & Associés.

Alexis Fournol advises French and international collectors, art market professionals, artists, estates and institutions on art-market, cultural property and ownership disputes.

How Fournol & Associés can assist

Fournol & Associés regularly advises and represents clients in provenance, ownership, recovery and restitution matters involving artworks and collectibles. The Firm has handled, and is currently handling, several matters involving competing ownership claims, disputed provenance, cultural property, cross-border recovery and restitution issues.

Our practice combines French property and civil law, cultural heritage law, private international law issues and art-market litigation.
