In France, it does not. <\/strong>The legal framework can be entirely different depending on whether the claimant is a private owner, another EU Member State, the heir of a person dispossessed during the Nazi era, or a foreign State seeking the return of cultural property from a French public collection.<\/p>\n<h2>Private claims usually begin with property law<\/h2>\n<p>Where one private party claims an artwork held by another, the dispute may fall under ordinary French civil law. The rules on possession, theft and loss in <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000019017163\"><strong>Articles 2276 and 2277 of the French Civil Code<\/strong><\/a> may be relevant, alongside contract, inheritance, limitation and private international law.<\/p>\n<p>Calling a claim a \u201crestitution claim\u201d does not itself determine the applicable rules. The factual basis of the alleged dispossession remains essential.<\/p>\n<h2>The European Union has a specific return mechanism<\/h2>\n<p>The <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006074236\/LEGISCTA000006159929\"><strong>French Heritage Code<\/strong><\/a> implements a special mechanism for cultural objects located in France that were unlawfully removed after 31 December 1992 from the territory of another EU Member State.<\/p>\n<p>The regime gives the requesting Member State procedural tools to identify and preserve the object and, where necessary, seek its return. It also contains specific limitation periods. Under Article L. 112-10, the return action is generally time-barred three years after the requesting State becomes aware of the location of the object and the identity of its possessor or holder, and in principle thirty years after the unlawful removal, subject to special longer protection for certain collections and ecclesiastical goods.<\/p>\n<p>This public-law return mechanism should be distinguished from a private owner&#8217;s ordinary civil claim.<\/p>\n<h2>Nazi-era spoliation has its own French framework<\/h2>\n<p>France has progressively strengthened the mechanisms for identifying and returning works spoliated in the context of antisemitic persecution between 1933 and 1945. The <a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047874541\"><strong>Law of 22 July 2023<\/strong><\/a> created a framework allowing qualifying cultural property to leave protected public collections for restitution.<\/p>\n<p>The legal status of MNR works is different from that of works belonging to public collections, and privately owned works raise yet another set of questions. A 1933\u20131945 provenance issue must therefore be legally classified before the relevant procedure can be identified.<\/p>\n<h2>A new framework was adopted in 2026 for certain State claims<\/h2>\n<p>The <a href=\"https:\/\/www.legifrance.gouv.fr\/eli\/loi\/2026\/5\/9\/2026-351\/jo\/article_1\"><strong>Law of 9 May 2026<\/strong><\/a> introduced a framework for the restitution to requesting States of certain cultural property belonging to French public collections where the property was illicitly appropriated between 20 November 1815 and 23 April 1972 and the statutory conditions are satisfied.<\/p>\n<p>The legislation does not create a general automatic right to restitution for every object acquired during the colonial period.
